Hire Agreement Terms, Conditions & Disclaimer

 

Terms and Conditions Definitions

 

Owner: BubbleWrapFun LTD Pony Cycle Hire

Hirer: The person hiring/renting the equipment from the owner.

​

Equipment: The Pony Cycles and accessories hired out by the owner to the hirer.

Contract: The agreement between the owner and the hirer for the supply of equipment at a negotiated price, within a defined hire period as bound by the terms and conditions. The hirer acknowledges the agreement becomes binding upon issuing an order either verbal or written requesting the owner to provide equipment and/or services to the hirer.

Payment: The hirer agrees to pay the owner's hire charge and any other charge, including charges for damage and repairs, loss that may be incurred and paid by the owner. These charges will be paid in full by the hirer to the owner prior to the owner releasing the equipment to the hirer. Subsequent charges arising from loss, damage, repairs, and other expenses are to be paid immediately upon receipt of a tax invoice.

Hirer's Obligations: The hirer will be responsible for the equipment hired from the time of its delivery until collection by or return to the owner. The hirer upon installation, delivery, or collection of the equipment immediately examines the equipment to satisfy itself to its condition and suitability for the purpose for which it requires the equipment. The hirer will assume the risk and indemnify and hold the owner harmless from any and all property damage and personal injury resulting from the use of the equipment. The hirer will be responsible for all surface preparations and repairs. The hirer will use the equipment in a proper, safe manner and only for the purpose and capacity for which it was designed.

 

1. DELIVERY: The hirer to provide clear access to the area where the equipment is going to be set up before and after your event. The hirer to secure all dogs before setup. The hirer to sweep and clear the hard surface that Pony Cycles will be ridden on of anything that may cause damage to the wheels e.g. Gravel, Sticks & Rubbish.

 

2. OPERATION: The hirer will provide a person over 18 years who shall supervise the use of equipment at all times. In particular, the hirer shall ensure:

    A. That he/she has a continuous clear and unobstructed view of the equipment and the children thereon;

    B. Not to allow overcrowding on the Pony Cycles. Only 1 person is allowed on one at any one time.

    C. Not to allow any persons that exceed the weight limit on any one of the 3 sizes of Pony Cycles:

        - Small – 75kg

        - Medium - 95kg

        - Large - 120kg

    D. That Pony Cycles are ridden on suitable flat surfaces only like Concrete Driveways, Asphalt, and Wooden floors. They must NOT be ridden on gravel, grass, sand, dirt, or any other uneven surface.

    E. No eating, drinking, or chewing gum while on the Pony Cycle to avoid damage and staining of materials.

    F. No flammables near the Pony Cycles. This includes smoking and barbeques.

    G. No riding into another Pony Cycle or object causing damage. No fighting, pushing, or behavior that could cause injury.

    H. The Pony Cycle must not be operated or left in the rain. In the event of rain, the Pony Cycles must be stored under shelter.

    I. In the event that the Pony Cycle stops working as it should, please ensure the rider gets off the Pony Cycle immediately and contact the owner.

    J. Pony Cycles do not go backwards and must not be forced or dragged backwards or sideways. They go in forward motion only and should be turned via the handles on the head.

    K. Do not use foot pedals as steps to climb onto the Pony Cycle. The rider must lift their leg up and over the Pony Cycle seat to get on.

 

3. CLEANING: The hirer will take responsible steps to ensure the Pony Cycles remain in a clean condition. If something is accidentally spilt on the Pony Cycle, please wash it off immediately with a damp cloth. The hirer will pay a cleaning fee of $70 if the equipment is picked up in a dirty condition.

 

4. LOSS OR DAMAGE OF EQUIPMENT: The hirer will be responsible for lost or stolen equipment for any reason whatsoever. It is agreed that upon the completion of the hire period, the whole of the replacement cost of the missing equipment will be charged to the hirer. If the equipment is damaged in any way during the hire period, the hirer shall be charged a fee to cover the repair or replacement of the damaged hire equipment parts or whole equipment. All broken and damaged equipment must be returned to the owner; otherwise, they are classified as missing items.

 

5. COLLECTION: BubbleWrapFun LTD is hereby authorised to enter any premises upon which the equipment may be located or thought to be located for the purpose of collecting the same at the conclusion of hiring. All Pony Cycles must be in the same condition as when they arrived. We reserve the right to take a photo of the Pony Cycles on your property. This is for proof reasons if the Pony Cycle is picked up in unacceptable condition. In the event of rain, we reserve the right to come out and pick up early if the Pony Cycles cannot be put under shelter for the remainder of the hire.

 

6. DISCLAIMER: BubbleWrapFun LTD has explained the policy requirement regarding supervision of equipment to the person named below. The person(s) or organisation hiring this Pony Cycle equipment will be responsible/legally liable for any damage to property or injury to any person occurring from or as a result of misuse or reckless use directly or indirectly related to the activity. These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are fully adhered to at all times. Our company, BubbleWrapFun LTD, cannot accept any responsibility or action taken for any injury caused to anyone using this equipment.

 

I have read the above agreement and fully understand and accept the terms & conditions above.

 

I am aware that whilst in my care, I am fully responsible for the Pony Cycles and their accessories and will pay for any loss or damage that may occur. This includes the Pony Cycles being returned in an unacceptable condition, i.e., if they are in a dirty or muddy condition, I will be expected to pay an additional cleaning charge.
